The Verkhovna Rada recommends adopting a draft law as a whole on protection of the interests of owners of land shares
The Committee on Agrarian and Land Policy reviewed the draft Law No. 11150 "On Amendments to Certain Legislative Acts of Ukraine Regarding the Protection of the Interests of Owners of Land Shares (Shares), as well as the Application of Administrative Procedures in the Field of Land Relations" and recommends that the Verkhovna Rada adopt it as a whole.
The draft law provides for:
extension (from 2025 to 2028) of the registration period for unclaimed land plots, distribution of land plots between owners of shares and their heirs of lands remaining in collective ownership after the distribution of land plots;
restoration of the obligation to upgrade the qualifications of certified land surveyors;
extension until 2026 of the pilot project of entering information into the State Land Cadastre by certified land surveyors;
making it possible to use the funds received in the relevant budgets in order to compensate losses of forestry production for the development of work projects of land management and the implementation of measures provided for by these projects;
establishing that the funds from the compensation of losses for agricultural purpose, which remained in local budgets before the abolition of the institute of losses of agricultural production, are spent on land protection;
establishment of a rule according to which the term of validity of lease contracts for land plots formed from unclaimed (unallocated) land plots that have passed into communal ownership is terminated 2 years after the state registration of the right of communal ownership to them;
establishing the obligation to attach to the land management documentation, which is being developed for the purpose of entering into the State Land Cadastre information about the formed land plot, copies of the documents on the basis of which the right of ownership and use of such land plot was acquired (if available);
restoring the possibility of carrying out measures to exchange the rights of use of agricultural land plots located in the massif of agricultural land on the basis of a court decision.
In addition, the project proposes to foresee the peculiarities of the administrative procedure in the field of land relations.
